1. Agreement to Terms

By accessing or purchasing from neckadjust.shop (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Site. These Terms apply to all visitors, users, and customers. We reserve the right to update these Terms at any time; continued use of the Site after changes constitutes your acceptance.

2. Health & Medical Disclaimer

The Neck Adjust device is a general wellness product designed for comfort and relaxation. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition or disease.

• Always consult a qualified healthcare professional before using this product if you have any existing neck, spine, or musculoskeletal condition, injury, or surgery history.
• Do not use this product as a substitute for professional medical advice, diagnosis, or treatment.
• Discontinue use immediately if you experience pain, discomfort, numbness, or any adverse reaction and consult a doctor.
• This product is not suitable for children under 18, pregnant women, or individuals with osteoporosis, herniated discs, fractures, or any condition affecting the cervical spine without prior medical clearance.
• Neck Adjust makes no medical claims. Any testimonials or results described on this Site reflect individual experiences and are not guaranteed.

By purchasing and using the Neck Adjust device, you acknowledge that you have read and understood this disclaimer and assume full responsibility for any risks associated with its use.

3. Eligibility

You must be at least 18 years of age to place an order. By placing an order, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding contract. We reserve the right to refuse orders from anyone at any time.

4. Products & Pricing

All product descriptions, images, and specifications are provided in good faith and to the best of our knowledge. We reserve the right to:

• Modify or discontinue products at any time without notice.
• Correct typographical errors, inaccuracies, or omissions in pricing or product information at any time, including after an order is placed.
• Limit quantities of any product sold.
• Refuse or cancel any order if we suspect fraud, unauthorized or illegal activity, or if an error in price or product information is identified.

Prices are listed in USD and are subject to change without notice. We are not responsible for price differences caused by currency conversion if you are purchasing from outside the United States.

5. Orders & Payment

By placing an order, you authorize us to charge your selected payment method for the full order amount. All payments are processed securely through Stripe. We do not store your full payment card details. Order confirmation emails do not constitute a binding acceptance of your order — we reserve the right to cancel any order after confirmation for reasons including but not limited to stock unavailability, payment failure, or suspected fraud.

6. Shipping & Delivery

We offer free shipping on all orders. Estimated delivery times are provided in good faith but are not guaranteed. We are not liable for delays caused by shipping carriers, customs, weather, or other events outside our control. Risk of loss and title for purchased items passes to you upon delivery to the carrier.

7. Shipping Protection Plan

Neck Adjust offers an optional Shipping Protection Plan for an additional $5.00 at checkout. By adding Shipping Protection to your order, you are covered in the following scenarios:

• Damaged in transit: If your order arrives visibly damaged, we will reship your order at no additional cost. You must notify us within 7 days of delivery and provide photographic evidence of the damage. The damaged item must be returned to us before a replacement is dispatched. Return shipping instructions will be provided upon approval of your claim. We reserve the right to deny reshipment if the item is not returned.
• Stolen package: If your tracking shows your package as delivered but you did not receive it, and you believe it has been stolen, you must file a police report with your local law enforcement and provide us with a copy of that report for review. Upon verification, we will reship your order at no additional cost. We reserve the right to decline reshipment claims that we reasonably believe to be fraudulent.

Shipping Protection applies to a single reshipment per order only. It does not cover:

• Packages marked undeliverable due to an incorrect address provided at checkout.
• Delays in transit that do not result in loss or damage.
• Claims submitted more than 14 days after the delivery date shown on the tracking record.
• Orders where a police report is required but not provided (stolen package claims).

The Shipping Protection fee is non-refundable once your order has shipped. To file a claim, contact us at info@neckadjust.shop with your order number and supporting documentation.

8. Returns & Refunds

We offer a 30-day money-back guarantee on all orders. To be eligible for a return:

• You must contact us within 30 days of delivery.
• The item must be in its original or reasonably used condition.
• You must provide proof of purchase (order number or confirmation email).

Refunds are processed to your original payment method within 5–10 business days of us receiving and approving your return. We reserve the right to refuse returns that do not meet the above criteria or that we reasonably believe are being abused. Return shipping costs are the responsibility of the customer unless the item was defective or incorrectly sent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Neck Adjust, its owners, directors, employees, and agents shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Personal injury or property damage arising from your use or misuse of our products.
• Damages resulting from unauthorized access to or alteration of your data.

Our total liability to you for any claim arising from or related to your use of our products or Site shall not exceed the total amount you paid to us in the 12 months preceding the claim. Some jurisdictions do not allow certain limitations of liability; in such cases, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Neck Adjust and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Site or products; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Site.

11. Intellectual Property

All content on this Site — including text, graphics, logos, images, product designs, and software — is the property of Neck Adjust or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

12. User Conduct

You agree not to use the Site to:

• Engage in any unlawful, fraudulent, or harmful activity.
• Submit false, misleading, or defamatory reviews or content.
• Attempt to gain unauthorized access to any part of the Site or its systems.
• Use automated tools to scrape, crawl, or harvest data from the Site without permission.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.
